What is a LMIA?
A Labour Market Impact Assessment (LMIA) is a document that an employer in Canada may need to get before hiring a foreign worker. A positive LMIA will show that there is a need for a foreign worker to fill the job. It will also show that no Canadian worker or permanent resident is available to do the job. A positive LMIA is sometimes called a confirmation letter.
Employer Responsibility
Apply for a Labour Market Impact Assessment (LMIA) to determine if they can hire a foreign worker to fill labour or skills shortages on a temporary basis. Employers need to understand the various streams for hiring temporary foreign workers in order to determine which program will help them meet their particular needs.
Employee Responsibility
Once an employer gets the LMIA, the worker can apply for a work permit. To apply for a work permit, a worker needs:
• a job offer letter,
• a contract,
• a copy of the LMIA, and
• the LMIA number.
International Mobility Programs
The International Mobility Program allows employers to hire temporary foreign workers without a Labour Market Impact Assessment (LMIA).
LMIA Exemptions
Sections 204 to 208 of the Immigration and Refugee Protection Regulations (IRPR) provide the regulatory authority to issue a work permit to a worker who does not require a Labour Market Impact Assessment (LMIA).
